Chevy Shake Class Action Lawsuit Continues For Florida Customers

A Chevy shake class action lawsuit will proceed, but not on a nationwide basis reports Carcomplaints.com. Owners who experience problems may be entitled to compensation.

The Florida plaintiff said his new 2015 Chevrolet Silverado 1500 suffered from the so-called Chevy shake that caused his truck to violently shake when it reached about 70 mph and shakes strongest in the range of 75-80 mph. The lawsuit alleges the plaintiff paid more than $2,000 to replace the brakes, rotors, tires and for re-rounding of the rims. The plaintiff says he also took the truck back to a Firestorm store for realignment and rebalancing of the tires, but the violent shaking allegedly continued.

According to the class action, defective driveshafts cause the following vehicles to violently shake while driving.

  • 2015 to present Cadillac Escalade
  • 2014 to present Chevrolet Silverado
  • 2015 to present Chevrolet Suburban
  • 2015 to present Chevrolet Tahoe
  • 2014 to present GMC Sierra
  • 2015 to present GMC Yukon/Yukon XL

    1. Shake/ vibration Problem

The shake is allegedly caused by aluminum driveshafts that eventually deteriorate and fail as the driveshafts drop to the ground. The plaintiff argues General Motors sent technical service bulletins (TSBs) to dealerships for 10 years concerning the Chevy shake but allegedly refuses to make permanent free repairs to the vehicles. According to the class action, victims of the Chevy shake continue to pay for repairs even when the vehicles are allegedly still covered by warranties.

Some suggest you can can get rid of the Chevy shake by replacing the aluminum driveshafts with custom-made steel driveshafts. But the cost of installing a steel driveshaft is thrown onto the customer because the automaker won’t recall the vehicles and won’t cover repair costs.

In addition, the plaintiff claims multiple GM models suffer the Chevy shake, yet the plaintiff doesn’t own any of those other models.

The automaker also argued the plaintiff apparently wants a limited warranty to last a lifetime because a GM dealer refused to pay for repairs after the Silverado warranty allegedly expired.

The judge ruled the lawsuit can proceed for Florida GM customers but there will be no nationwide class action lawsuit. According to the judge, the Magnuson Moss Warranty Act claim is the only federal claim asserted in the lawsuit, and the claim depends on Florida law.

The judge ruled the plaintiff doesn’t claim a legal injury in any state other than Florida and doesn’t allege an injury under the laws of any other state.

“Therefore, the Plaintiff lacks standing to assert claims on behalf of class members who purchased GM vehicles outside of Florida.” – District Judge Robert N. Scola, Jr.

Although the claim for nationwide class action certification was dismissed, the judge did allow the Florida class action to continue based on breach of express warranties, breach of implied warranties and violation of Florida’s Deceptive and Unfair Trade Practices Act.

  1. well lets see i was sold a truck with the dealership knowing the a8 tranny has had issues GM known since 2o15. the service dept knew and so did management they had to they were getting the how to repair memos since 2o15 . no warning about issue before purchase my 2o18 truck and from what i have read on line no permanent fix still trying to fig it out no fix yet just band-aids from what i researched . so i had to loose a days work of over time taking truck in unsafe to drive in my op ion almost wrecked twice . arrived there at 73o am ask for vehicle to get around in truck had only thousand miles on it , then asked how long will the trnny flush take . the man said 2.5 hours . i said ok i can wait well 4.5 hours later they called saying im ready to go trucks done . they flushed the tranny per work order from gm. for this is the first step and cheapest for temporary fix . now im wet from walking in the rain , hungry and ready to just go get my truck back and go home . well it has not been detailed or vacuumed out . cant complain to much about that but felt it should have been done, but knowing a new truck with only 7 k miles on it almost got in a wreck twice very dangerous to drive and i was feeling unsafe driving it .they mite of cleaned the truck up after working on it nope guess not .in my op ion something the company or dealership should of fixed before selling me the truck or say any thing with the said mentioned chevy shake because of the tranny in it so GM say . should have corrected the issue or warned me before selling it knowing it has been a issue since 2o15 . i was told they have the autos in there all the time for the same fix mine was the first of four for the same issue for that day . i took it in for tranny to be flushed . so the only reason i gave such a high score is because i truly dont think the young lady who sold me the truck had a clue about this issue . scared if what i read is true and this is only a short time repair band-aid fix . that i got lucky the first two times when i almost wreck that i did not have any vehicles around me when i crossed the center lane from this issue . i worry i will not be that lucky when the band – aid falls off and the issue comes back no longer feel safe in a brand new top of the line chevy colorado scary . GM really disappointed me on this every new auto i bought in my life for my self has been GM i should have never been sold a defective auto only 7k miles on it ,no one should without a warning just should not of been done . now its like when i drive when is it going to come back how many miles and where will i be and will it get in in a wreck . i feel they should buy the truck back for they dont know how to permanently fix it . they should buy them all back . brian feeney
