Lemon law claims lady

Owners of the Nissan Altima have complained about transmission problems.  The variable automatic transmission may malfunction with problems including hard shifting,  stuttering between gears, hesitation and sputtering, vibration, or failure.  No recall to address this has been issued though Nissan has been aware of the problem.  Vehicles with problems include,

2013 Nissan Altima (four-cylinder engine)

2014 Nissan Altima (four-cylinder engine)

2015 Nissan Altima (four-cylinder engine)

2014 Nissan Rogue

2015 Nissan Rogue

2016 Nissan Rogue

A service bulletin attempted to address the problem.  Corrective action: Dealers will either replace the transmission or the valve body inside it. If a new valve body is installed, a new oil pan with an additional magnet will also be installed to collect excess metal fragments that develop over time as a result of normal transmission operation. Read more at https://www.cars.com/articles/2013-2016-nissan-altima-rogue-transmission-issue-1420683183828/#k58UEThoOihyVEiK.99

Nissan Pathfinder Transmission Defect

A class action has been filed alleging multiple defects in the Nissan Pathfinder transmission.  That action references multiple service bulletins identifying problems with the vehicle.

“21. In fact, on January 10, 2013, Nissan sent its dealers Technical Service Bulletin (“TSB”) No. NTB13-002, titled “VOLUNTARY SERVICE CAMPAIGN / 2013 PATHFINDER TCM REPROGRAM.” That TSB stated that “Nissan is conducting this voluntary service campaign to reprogram the Transmission Control Unit (TCM) on certain specific 2013 Model Year Pathfinder vehicles.” The TSB also stated that the reprogramming “will prevent a CVT belt slip condition from occurring and will be performed at no charge for parts or labor.”

22. TSB No. NTB13-002 also explained that it did not apply to vehicles where there is “not a match” with the list of applicable TCM Part Numbers, which may occur in circumstances where the reprogramming “has already been done.” Through this statement, Nissan acknowledged that it had reprogrammed the TCM on some 2013 Pathfinders prior to issuing the TSB, likely prior to their sale or lease to consumers, which indicates that Nissan was aware of the CVT defect before many of the 2013 Pathfinders entered the market.
23. TSB No. NTB13-002 also included a draft letter to current owners of Nissan Pathfinders informing them that “the Continuously Variable Transmission (CVT) belt may slip in some affected 2013 Nissan Pathfinder Vehicles. An indicator that the CVT belt has slipped is a shaking or a ‘judder’ from the CVT when coasting.” The draft letter also misinformed consumers that “[t]his is not a safety issue, and the vehicle still meets and/or exceeds all applicable safety standards.”

24. The TCM reprogram prescribed by TSB No. NTB13-002 did not correct the defect in the Vehicles’ CVT. Rather, the Vehicles’ owners and lessees continued to experience the CVT’s shaking and juddering and the dangerous failure of their transmissions to accelerate properly. Nissan, instead of disclosing its knowledge of the Vehicles’ dangerous defect, concealed that knowledge by issuing the ineffective TSB No. NTB13-002 to allay consumers’ concerns.

Nissan Altima Sensor Defect

A Federal court has allowed claim based upon problems with the Nissan Altima, Leaf, Pathfinder and Sentra.  The consumer claimed  his 2013 Nissan Altima has faulty sensors that could render the air bags inoperative. He can proceed with his deceptive-business-practices claim against Nissan North America, a federal judge has ruled.  Zaccagnino et al. v. Nissan North America Inc., No. 1:14-cv-03690, 2015 WL 3929620 (S.D.N.Y. June 17, 2015).
U.S. District Judge Louis L. Stanton of the Southern District of New York ruled that plaintiff Andrew Zaccagnino plausibly alleges that Nissan knew but did not disclose that a 2014 recall had not remedied the defect in all affected vehicles.
“That is sufficient to plead that those omissions were materially misleading,” the judge ruled.   According to the complaint, the sensor software can register an occupied passenger seat as empty, deactivating the air bag and increasing the risk that an accident could injure the passenger. The plaintiff filed suit on behalf of all owners and lessees of the 2013-2014 Altima, Leaf, Pathfinder and Sentra; 2013 NV200 cargo van; 2013 Infiniti JX35; and 2014 Infiniti Q50 or QX60. Westlaw Journal Automotive, Vol. 34, Iss. 4, 34 No. 4 WJAUTO 8).

In refusing to dismiss the business-practices claim, Judge Stanton said N.Y. Gen. Bus. Law § 349 prohibits deceptive acts or practices that are “misleading in a material way.”

2013 Infiniti QX56 defective engine

Nissan Infiniti owners have complained of problems with the engine and other components of the QX56.  Owners may be entitled to compensation for loss of use, repair costs, or other damages.

Here is a typical complaint from Nissan Infiniti owners.

“Last week when I was on the highway in my ’11 QX56 (56K miles) my SES light started flashing, the engine started misfiring, and would barely stay running at idle when I pulled to the side of the road. I shut it down, restarted it, and much to my surprise the engine ran perfectly. The SES light was no longer flashing, but stayed on for the remainder of the day. The next day I fired it up and poof, no SES light. Regardless, I called the dealer to schedule an appointment.

Once Infiniti took a look at it, I was told that it needed a new timing chain and that parts were ordered.  I asked the service manager if the replacement parts were improved, and thus will permanently solve the problem, or if this may be a chronic concern/problem area for the vehicle… He said they’ve already done a handful of timing chain replacements, but due to the age of the vehicle it was too soon to tell. I then asked about warranty coverage of a repeat occurrence and he confirmed that the next repair would be on me if the 70k mile powertrain warranty was up. This is understandable; however, it has caused me to evaluate my long-term ownership of the vehicle, due to the potential repair cost. The timing chain is roughly a $2k repair out of warranty.

Does anyone know if the timing chain repair/replacement is a permanent fix? Anything else to consider/think about, or any other facts regarding timing chain issues known? I really like the vehicle, but am considering trading it off for another brand.”
