Ford Escape, Fiesta Coolant Leak

Ford announced that a coolant leak recall is set to begin for owners of Ford Escapes, Fiesta STs, Fusions and Transit Connects, with 2014 Escape SUVs first on the list.  The recall was first announced in March 2017 that covers about 230,000 model year 2014 Ford Escape, 2014-2015 Ford Fiesta ST, 2013-2014 Ford Fusion and 2013-2015 Ford Transit Connect vehicles.  The vehicles can overheat and catch on fire because a lack of coolant causes the cylinder heads to overheat and the heads to crack. This can cause pressurized oil leaks that can result in engine compartment fires.  All the vehicles are equipped with 1.6-liter EcoBoost engines, but when all the vehicles will be repaired is up in the air. Ford says parts are now available to complete the recall on Escape SUVs only.

The coolant leak may leak to air-conditioning problems, engine issues, and other concerns.  Owners experiencing problems may be entitled to compensation.

CHRYSLER PACIFIC STALLING AND RECALL

cropped-man-with-broken-car.jpg

Owners of  the 2016-18 Chrysler Pacific have experience engine and stalling problems on their vehicle.  Owners may be entitled to compensation or new vehicles because of these problems.  One source explains,

“Chrysler Pacifica stalling problems have caused a recall that will allegedly fix problems that typically occur while the minivans are making turns, driving slow steady speeds, while idling or when starting.

The recall includes nearly 154,000 model year 2017 Chrysler Pacifica non-hybrid minivans in the U.S., nearly 7,500 in Canada, more than 970 in Mexico and about 245 outside North America.

Pacifica drivers who complained about stalled engines were allegedly able to restart their minivans immediately afterward.

Fiat Chrysler (FCA US) says “under a rare set of conditions” the engine control module (ECM) can misread the operating status of the engine, causing the engine to stall.

Chrysler knows of one crash allegedly connected to the stalling problem, but is unaware of any injuries.

FCA says the fix involves dealers installing updated engine control software, but the automaker didn’t say when this will occur.

Owners of the recalled minivans may contact FCA customer service at 800-853-1403.

The 2017 Chrysler Pacifica recall follows a petition to investigate stalling problems in the minivans filed by the Center for Auto Safety (CAS) and Pacifica owner Adam J. Cohen. The November 2017 petition asked the National Highway Traffic Safety Administration (NHTSA) to open an official investigation into complaints made about the minivans.

In addition to wanting NHTSA to investigate the problem, CAS said FCA should recall the non-hybrid minivans and provide loaner vehicles until the Pacificas are correctly repaired.”  http://www.carcomplaints.com

GENERAL MOTORS TRUCK AND SUV AIR-CONDITIONING PROBLEMS

AC button 2

Five class actions have been filed against GM stating that certain GM trucks and SUVs were sold with a defective air conditioning system.   Even GM acknowledges that the claims ‘share factual questions arising from the allegations of a common defect.’

1. Vehicles Covered

Complaints have been reported about,

Cadillac Escalade (model years 2015-2017),
Chevrolet Silverado 1500 (model years 2014-2016),
Chevrolet Suburban (model years 2015-2017),
Chevrolet Tahoe (model years 2015-2017),
GMC Sierra 1500 (model years 2014-2016)
GMC Yukon (model years 2015-2017)

2. Defect and Cause of the Air-Conditioning Problem

Several of the components in the air conditioning system are “too weak to
hold the pressure of the coolant” which builds up when the system is on.  One problem is that the discharge lines and condensers are too weak to handle the pressure the coolant is under.   Parts are causing coolant to leak out and air to seep in, which causes water vapor to freeze into ice, blocking the circulation of coolant.  The fluid is forced out of the system, making the system ineffective, and creating other potential problems.

3. Claims

Claims may be filed for breach of implied warranty, lemon law, express warranty, and violation of the federal Magnuson-Moss Act.  Further, complaints  allege that GM
knew about the alleged air conditioning defect, withheld that information from the public, and continued to advertise and sell the vehicles without informing purchasers of any issue.   Service bulletins related to the air conditioning defect were issued in
October 2014 and May 2015, online forums that contained customer complaints, and there have been ae number of claims for AC System repairs and part replacements
made during the car’s warranty periods.

CHRYSLER PACIFICA ENGINE STALL AND TRANSMISSION PROBLEM

car-1751750_960_720
Owners of 2017 Chrysler Pacificas have complained of stalling, poor engine performance, hesitation, and transmission concerns.  Owners may be entitled to refunds, compensation or replacement vehicles.

Carcomplaints.com reports,

“A Chrysler Pacifica engine stall lawsuit alleges the minivans can die on the highways at any speed, and Fiat Chrysler (FCA US) has no idea how to fix the problems.  The lawsuit includes all U.S. residents who purchased or leased 2017-2018 Chrysler Pacifica minivans equipped with 3.6-liter V6 engines and 9-speed 948TE automatic transmissions.

The Pacifica engine stall proposed class-action lawsuit was filed after the National Highway Traffic Safety Administration was petitioned by the Center for Auto Safety to investigate complaints about 2017 Chrysler Pacifica engines that stall while driving.   The petition says minivan owners report that dealers try different repairs to solve the stalling problems, including replacing the transmission and voltage control modules or updating the software. In addition, technicians try replacing the fuel tanks and modules, replacing the electrical power distribution boxes and making sure no loose battery connections exist.

However, owners report the repairs don’t stop the engines from dying in the middle of the roads.

The 2017 Chrysler Pacifica is reportedly an updated version of the Chrysler Town & Country, with a 9-speed automatic transmission and a “gearbox lifted from the Chrysler 200 sedan.”

If you own a 2017 Chrysler Pacifica and have experienced similar problems, you may be entitled to compensation or other remedy.  Call Howard Gutman at (973) 598-1980 for a free consultation on your problem.

Automobile Extended Warranty Information Sources

While many consumers purchase warranty plans for piece of mind, they may find companies refusing to provide coverage.

1. Parties to Sue

Generally claims should be filed against both the dealer and the warranty company.  Otherwise, the dealer says the warranty company failed to provide coverage and the warranty company argues the problem existed when the car was sold invalidating the coverage.

2. Defenses

Warranty companies aggressively try to avoid coverage despite the needs of the consumer, many of whom desperately need their car.  Here are some typical defenses and the response.

  • pre-existing condition-    Why didn’t the company inspect the car in the same way an insurance company asks for a medical examination before providing coverage.
  • hidden disclaimers           check the company’s literature and see if the promises conflict with disclaimers.  If so, that may be false advertising.
  • lack of maintenance         coverage should accord with the reasonable expectations of the insured and minor gaps should not bar coverage.
  • bogus report                     Frequently the warranty sends out an inspector whose job it is to avoid coverage.

Here are some further sources of information on automobile extended warranties.

Hyundai Tucson Transmission Defect

Lemon law claims ladyHyundai owners have complained about problems and malfunction in the 2016 Hyundai Tucson.  A class action is being evaluated.    Recently the company  announced a recall of the 2016 Hyundai Tucson to fix a software problem that could disable acceleration.

One article suggests, the problem is rooted in the Tucson’s transmission control module, which was supplied by Dymos Incorporated that controls controls gear-shifting on the Tucson’s seven-speed, dual-clutch transmission.

“In higher ambient temperatures and specific operating conditions, the transmission clutch application logic can result in a delayed engagement when accelerating from a stop. If the accelerator pedal is steadily depressed for approximately 1.5 to 2 seconds, the vehicle will begin to accelerate and normal driving is resumed. However, if the accelerator pedal is repeatedly cycled, the vehicle will not accelerate.”  http://www.thecarconnection.com/

FREE CONSULTATION ON YOUR GMC YUKON TRANSMISSION PROBLEMS

Keywords 2015 GMC Yukon defects, GMC Yukon complaints, GMC Yukon lemon law, recall, class action.

Owners of the GMC Yukon have complained of multiple transmission problems.  These issues include:

Hesitation, Car Switches In 4wd And Does Not Allow For Safe Turns, Vibration From Transmission, Leaking Transmission Cooler Lines, Shifts Random To Neutral, Slips From Park Into Neutral.  See Carcomplaints.com

Here is a typical complaint,

Issue Reported: Oct 07, 2014

Vehicle: 2015 GMC Yukon

NHTSA: Action Number: 1116072 Service Bulletin Number: 10643049

Component: service brakes

Summary: I have a brand new 2015 yukon denali (short wheel base) with less than a thousand miles and a “service 4wd” message that has appeared twice rendering the car extremely unsafe and un-drivable for a long distance and having to have it towed to the dealer twice. A software update was done on the car the first time, only resolved the issue for a few weeks, the issue re-occurred after 3 weeks. When turning the vehicle on the dash gives the message “service 4wd”. The car has a transmission button to change from 2wd, auto, 4 high and 4 low. I do not touch this button, i just leave the car in auto and drive. I do not tow anything, this is just a family car used for commuting. When the “service 4wd’ message appears, the car is barely drivable. When it is put in reverse, the car just brakes after a few feet, as if the parking brake were on, but it obvious is not engaged. When turning left or right, the car brakes mid-turn and will only complete the turn if 3/4 to full accelerator is applied to continue through the turn. The car slightly bucks through the turn and the engine sounds different and has little power going around corners and going up hills. The car cannot safely be driven in a straight line faster than 40-50 mph. I telephoned onstar and diagnostics were run during both occurrences with the same error message from onstar diagnostics: “the braking system has an issue- transfer case module not working as expected”. When will gm issue a recall on this safety issue, i do not feel safe letting my wife and child in the car if it brakes by itself, loses power and cannot complete turns. I purchased this car to have a safe/large vehicle for my family: service 4wd appears on screen it renders the car un-drivable and the transmission button becomes inoperable and selecting other transmission modes becomes not possible.

A class action is pending dealing with suspension problems on Range Rover models.  Owners may be entitled to compensation for vehicle problems or  loss of use.  CALL FOR A FREE CONSULTATION.

“Law360, New York (March 19, 2015, 1:26 PM ET) — A New Jersey federal judge on Wednesday pared claims in a putative class action alleging Jaguar Land Rover Automotive PLC manufactured and sold Range Rover vehicles equipped with defective electronic air suspension systems, refusing to toss the common-law claims but cutting consumer protection claims as time-barred.
U.S. District Judge William H. Walls partially granted the automaker’s bid to dismiss a second amended complaint in the suit alleging model years 2003 to 2006 of the Range Rover have a suspension defect that causes the suspension system’s rubber air bellows to develop leaks, subsequently releasing air pressure and losing their ability to hold the vehicle’s weight.

The case is Majdipour et al. v. Jaguar Land Rover North America LLC, case number 2:12-cv-07849, in the U.S. District Court for the District of New Jersey.
